Filing divorce before/after interim maintenance

07-Apr-2024 (In Divorce Law)
i have a 125 crpc case going on. Will i have to pay more if i file for divorce after the interim maintenance order? Also if the wife files multiple cases further to harass me and make me go bankrupt, what legal step i should take?

Multiplicity of the maintenance is not Acceptable . But when you will file divorce then your wife will be filing an application for the interim maintenance in that case you can produce the order passed by the turntable court in 125 CRPC. Court can't grant maintenance above the salary ratios. All the harassment may brought before the court to show her deliberate conduct to harrase you and that amount to cruelty.

Dear Sir, The Courts also take into consideration the interim maintenance paid by you. Irrespective of pendency of Divorce case you have to pay interim maintenance. If wife files false cases like DV or 498A of IPC then approach High Court and get them quashed. You need not worry about the cases filed by your wife and take them as casual as possible see that and make her frustrated since she cannot get any result out of such cases.
