Filing divorce and sole custody of child..........................

I am not happy in my 4 year of marriage. I married at my home town , now I m in delhi from last 2 years .I and my husband both are not happy in our married life.We have 7 months daughter . And I want custody of my child. Kindly guide me

As far as the custody of the daughter is concerned her custody will remain with you as you are her natural guardian till she attains the age of five years. And if both of you are not happy with your marriage then you can opt for mutual divorce because it’s cost effective and gets over within maximum six months. You and your husband can sit independently or thru legal assistance and try to fix terms and take divorce by mutual consent as it’s easier and faster and since both r unhappy if u want you can contact us

hello client as you have mentioned tht you want sole child custody of your child yes it can be done for sure in your fevour from delhi itself . as divorce is concerned tht is also possible from delhi itself but it need to be confirmed from your side tht on what conditions you wapnt divorve from your husband.

Before taking divorce I would recommend you to give sometime by seperstion. But still if u want to go for divorce then either u can go for mutual or contested. Secondly, u can also take maintenance from your husband for your child n yourself. Third, child custody will be with you only bcoz she is infant. And upto certain age father cannot have custody of child out of few exceptions. B in touch .. thanks
