Police inaction after a complaint usually occurs when the dispute is treated as matrimonial/civil in nature or when they await prima facie material. This does not bar your legal remedies. You are not required to depend solely on the police to proceed with divorce. A marriage certificate from a temple is not mandatory to seek divorce. Marriage can be proved through photographs, witnesses, invitations, messages, or cohabitation records. Consent or signature of the husband’s parents is legally irrelevant. Their refusal has no bearing on your marital status or your right to divorce. If your lawyer is demanding excessive fees without delivering basic assistance, you are entitled to change counsel immediately. Fees must be reasonable and transparent; legal representation cannot be coercive. You may: File a divorce petition directly before the Family Court. Seek legal aid if financially or emotionally strained. Move the Magistrate/Court if police fail to act on a cognizable offence. You have a clear legal right to exit the marriage through due process. Do not allow delay, fear, or fee pressure to block your remedy.
