07-Jan-2023 (In Divorce Law)
I got married in 2012(*Hindu marriage). I hv 18months old daughter. My husband beats me very brutally n also tried to kill me. I hv filed 3cases as mentioned above. It has been past 4 months, he neither come on date n he is keep on changing lawyers. He is neither providing us any money. What should i do,? Can i file divorce in between or can he file or i hav to wait after completion of dv n maintenance bcoz dowry case has not yet been started. He bribed the police n all n they are not filing chargesheet.
No, actually police takes its own time to file chargesheet thats why it got delay in the cases of marriage. Yes you can file your divorce case in ththe meanwhile but i don understand why your maintainnace petiton is not passed
Yes ofcourse you can file divorce case also. You can aslo file maintenance for u and your daughter if u r nt a working woman and less qualified than ur husband. You have no need to wait for completion. You can file anytime as u want. Kindly provide me full details of your case so it would be better for advising.
Dear queriest,
From the above it is clear that you have suffered alot and are really looking at options to finish this at the earliest. However, please have some patience and faith in your attorney..

Yes you can file divorce case in competent court. Have you filed an application for maintenance in the court or not? If not you can file an application for maintenance before the Court. If your husband doesn't come/ appear in the court, the court can issue warrant against your husband, to arrest.
