Filed divorce case but wife not ready to come for hearing

20-Jan-2023 (In Divorce Law)
Hi, I am married for 9 years with 2 kids but due to multiple issues with my wife filed divorce, we are not living together since 4 years but still she is living with my family and I am giving her monthly amount for kids education and expenses but I have filed a divorce as I can’t continue to live like this and ready to pay her alimony amount also, but she is not ready for divorce. She came to court on 1st hearing but now not ready to come as per her if she doesn’t appear in court the judge will cancel the case. Please advise incase she doesn’t appear in hearings will court cancel the case.

File an application for warrant

if the court doesn't consider, move under writ before High Court.

It will be taken care and considered. Else, HC may issue an order to the lower court.

An ex party divorce would be granted to you if your wife didn’t turn on next up coming dates no judge can cancel your case if opposite party refused to attend hearing be ready to pay everything would be settled smoothly nobody can force you to live with someone you doesn’t want to live
