If your husband is cheating on you, you may consider filing for divorce on the ground of cruelty, depending on the facts and circumstances of your case. However, mere suspicion or an allegation of cheating may not be sufficient. The evidence and circumstances of the relationship will be important. You should consult a family law advocate who can examine your marriage details, available evidence, and the conduct of your husband before advising you on the appropriate legal remedy.

Yes, you can file for divorce against your husband on the ground of adultery/cheating. Under the Hindu Marriage Act 1955, Section 13(1)(i), adultery is a valid ground for divorce. Similarly, under Muslim Personal Law, cruelty and infidelity can be grounds for Khula or judicial divorce. To proceed, you will need to collect evidence to support your claim such as messages, photos, call records, or witness statements. You can file the case in the Family Court of your jurisdiction. Along with divorce, you can also claim maintenance for yourself and children under Section 125 CrPC and seek custody of children. I suggest you consult a lawyer with all documents and evidence so that a proper divorce petition can be drafted. The process usually takes time depending on court hearings and whether it is contested or mutual. Note: This is general legal information. For case-specific advice, please consult an advocate.

If your husband concealed that he already had a wife and two children before marrying you, you can take legal action. However, if his first Hindu marriage was legally valid and was never dissolved, your marriage is generally considered void, so the appropriate legal remedy is often not a divorce, but a petition for a declaration that the marriage is null and void under the Hindu Marriage Act.
