Fighting for conjugal rights but need divorce

I am 36 year old. I am fighting conjugal rights case as a petitioner from past 5 years. Now I realise there is no use of it. As my husband is in relation with someone else which I can't prove. My case is still active. In this time can I ask for divorce or mutual consent. My husband is asked for divorce 3 years back. If yes, please guide me what is the procedure. Will I get alimony/maintainance to lead my life further?

Yes, you may ask for divorce by mutual consent and discuss all the terms and conditions of separation. However it is advisable to do so through Mediation. Both parties can request the Court to refer the case for mediation and through mediation you may resolve the dispute. Regarding alimony, you can discuss this with the Mediator's guidance.

okay I understand your question so you do one think now you are already file RCR case right but your husband is not ready to reunion or rejoining with you so first you will take mediation and talk with him and discuss about the divorce and how much alemoney he will ready to pay on this time so if you want any legal help contact me thsnk you
