Family issue with husband and divorce related

The huband filed the divorce on the basis of cruelty and adultery. The wife filed section 9 ( to stay there) and section 125 of maintenance. A year has passed in this. Now the marriage for the wife is emotionally dead so she wants to file for divorce too and to ger her stree dhan back. Can she do it?

Yes, she can do that. Better she also files 498A read with section 496 IPC which is more effective. Courts may not get that jewellery but police can seize, raid and do whatever they like. if she wants divorce from husband then you withdraw your case which you have filled for living with husband and get compromise petition by husband and wife with your agreed terms and conditions court will pass decree of divorce

Yes there is possibility to settle the matter. Give a proposel to her husband for settlemant. Both of you request to the court to refer the case for lokadalath or medeation for settlemant. Then The court will do it as per your requirements. After settle the matter by taking and giving as like shridhan, maintainance, permanent alimony or any other monetary demands.
