False cases and matrimonial issue

I am married for more 2 years, my wife always demand sperate home and ask me to leave parents and she don't do household work. She is working. Since last 6 month she left the home on 14.09.21 and living in her parents home. I have tried all social method for convincing her to get back and also sent section 9 notice to her on 21.03.22 she filed complaint on 108 in Delhi for DV in women panchayat. I appered in women panchyat on 23.03.22 However In women panchayt even after my written submission and intention to take her back to matrimonial home she did not get agree and her parents demanded FIR which was refused by counselor as they found demands of wife unreasonable. Now she filed complaint in CAW cell in 29-03-2022 and they summoned me for apperance on 18.04.22. please suggest what should I do. Shall I file for section 9 or shall I file divorce. One of advocate suggest me to file section 9 she is destructive mode and under influence of her parents. I want to avoid maintenance.

In your case if you want to bring back your wife back to your matrimonial life then you can file section 9 and if you don’t want to live with her anymore then you can always file for divorce. The choice is all your and you have to decide. And according to my suggestion be the first one to file something in court so that anything filed by your wife after that can become suspicious and null & void. hello client as i can see your issue is serious i agree in this regarrs we are in dire need to reaching to court to show our bonafide as well as the things which be want to keep im front of tge court as well as the things which is been done on you by your wife as well as by your inlaws agaisnt you. as you do not wish to give maintinance so we need to stand on firm issues to keep our stand clear im front of the court.

If you wish to continue in the marriage then you should try to file Section 9 which deals with restitution of conjugal rights. however if you wish to not stay with your wife any longer then divorce would be the right option for you. Your wife has the right to file for maintenance and alimony which is decided by the courts on the merits of the case. Please call for further detailed discussion.

File section 9 has both pros & cons …if you need divorce & she doesn’t need n doesn’t even want to stay with you then this become automatic ground for divorce for you …! Anyways I would recommend you to leave your wife free for some time ..give her some space ! Time heals things but if u want to move ahead without her then b in touch
