False 498a on me and my family

Me and my wife both are working after one year of marriage we bought a car because of my wife wanted a bigger car then i told her to take staff vehicle loan from her bank but then she said she is eligible for only 3 lakh loan.then i bought car form my bank on 7 lakh loan and 3 lakh from my side and 4 lakh she transferred to my bank a/c.ow after 2 year she filed 498 a on menIs transferring money from working wife to working husband is crime

Hi Sir As per brief facts stated by you, no it isnt a crime if you or either your wife helps you monetarily as you are spouses/ marital ties. You need to elaborate more than a incident in order to show how did she rope you in 498 A FIR Pl call for further clarification on the issue Thanks Adv Dr Preeti

She cannot claim any maintenance or alimony in a 498A case. If she wants to get separated from you and wants you to pay her some maintenance or alimony then she has to file for a petition under section 125 crpc or an application under domestic violence case.

hello as per your query this is not a crime to take money from working wife for family assets, but your wife lodge fir against you in 498 a in these conditions you has not take huge pressure on you, no conviction under this reason held to you. no transferring of money from wife to husband is no crime the only crime is asking for dowry. in your case it is a mutual understanding between husband and wife and is not punishable under 498-Aof IPC. you can get this FIR quashed from the High Court.
