Fake RCR case filed by wife. How to dismiss the fake case

We are married for the last 15 months. My wife stayed with me only for only 5 months. She left matrimonial home for simple reasons i have proof that she left by her own. I sent legal notice to reunite and a police complaint to reunite but she filed RCR. She accepted to reunite but later filed RCR case in her home town just to put pressure on me. Can we dismiss this fake RCR case filed by my wife.She is working earning 30 thousand no kids and i have proof that she left by her own can she claim alimony and maintenance.

It is good that you have proof of the fact that your wife left the matrimonial bond on her own will. The best way to dismiss the restitution of conjugal rights case is to contest it with evidence of your notice and complaint for reunion. It is clear that your wife has misled the court and filed a false case.

RCR is for reunion. firstly you might have sent the divorce proceedings notice. now you can file divorce case. RCR not be dismissed as per the supreme court directions. the divorce is the only way to dismiss the RCR
