Facing Marital Tension and Possible future false allegations
15-Jun-2025 (In Divorce Law)
My wife lied to me about her education(mentioned 12th but not even 10th), and her health background(she is deaf in one ear) . I always try to maintain peace even after that. But she keeps gaslighting me makes fun of me in public, and keeps on recalling her past . It has been only 4 months into marriage but I am draining mentally and need a way out.
How can I proceed legally and divorce her.
I do not own any property and I want to protect my parent's property from any legal consequence
You can file for divorce under Section 12(1)(c) of the Hindu Marriage Act (if Hindu), citing fraud/misrepresentation regarding her education and medical condition. You may also seek divorce under Section 13 on grounds of mental cruelty due to gaslighting and public humiliation. Since you don’t own property, your parents' property cannot be claimed unless there’s proven transfer or contribution from your end. Keep records of all communications and incidents. Consult a local family lawyer to initiate legal proceedings and ensure protection of your family's assets.
You can file for divorce on the grounds of mental cruelty under Hindu Marriage Act. Suppressing facts like education and health condition may amount to fraud, which can be used to strengthen your case. Keep all evidence such as messages, witnesses, and behavior records. Regarding your parents’ property, since you don’t own it, it legally remains safe. However, avoid mixing your finances and ensure your parents' property is not shown as joint. Consult a local family lawyer to file a proper petition.
