Advocate Lalit Kumar answered

Q: I want to file divorce case for mental harrasment and domestic violenc

I want to file divorce on the basis of domestic violence and mental harrasment . My husband is mentally unstable . I don't want any alimony . Only want to get rid of him

Advocate Lalit Kumar answered
You can file a divorce petition under Section 13(1)(i-a) of the Hindu Marriage Act on the ground of cruelty due to domestic violence and mental harassment, and also under Section 13(1)(iii) if your husband is mentally unstable. Since you do not wish to claim alimony, the same can be clearly mentioned in the petition. Proper supporting evidence such as medical records, complaints or witness statements will strengthen your case. I can assist you in drafting and filing the petition before the appropriate Family Court to ensure you obtain relief at the earliest and are able to live peacefully without further harassment

Q: Whether to have divorce or not

My brother wife having extra marital affair and after thing short out again she by mistaken told to leave him as she will get a good job . Now what should my brother do

Advocate Lalit Kumar answered
If your brother’s wife is involved in an extra-marital affair, he should collect solid evidence like messages, photos, or witness statements. He can file for divorce under Section 13(1)(i) of the Hindu Marriage Act on grounds of adultery and mental cruelty. If she is threatening or making false allegations, anticipatory legal protection should be sought. A detailed consultation with a matrimonial lawyer will help decide whether to proceed with legal notice, divorce petition, or mediation based on her conduct.

Q: I am face 498 ipc and 406 and also face 125 and domestic violence

Please give me a helpful advice for that so I wil be relieved from tha ipc elegance please help as soon as possible thank you so much

Advocate Lalit Kumar answered
Aap turant ek experienced criminal lawyer se milkar case ka IPC section detail me samjhe. Agar arrest ka risk hai to anticipatory bail file karein. Saare documents, messages, call records, aur witnesses ka record rakh kar apna defence tayyar karein. Agar case jhootha hai to quashing petition (Sec. 482 CrPC) High Court me file karke relief liya ja sakta hai. Case ki gravity ke hisaab se settlement ya mediation ka bhi option consider karein.

Q: Crualty wife and I want to be divorce

Abhishek Srivastava name hai kiraye ke makan me rhta huam jha wife ke sath tha mere pariwar or mere khilaaf jhoothi police chauki me complaint likha di ghr ka sara saman Laker or meri bahen jo sath nhi rhti thi video banake dikhai usne glti se bola sra saman h jbki wo baad me saman le ja rhe the bahen ne dekha ma n bhi dekha fir apsi shmti k paisa 80000 paisa leke divorce ki baat ki ab nhi aa rhi to kya kre khi wo maintenance ya jhoothi 498 kregi to kya krenge kiraye dar unke support mh ple hel

Advocate Lalit Kumar answered
Aapke case me pehle aap apne paas available saare documents, videos, audio recording aur witnesses ka record rakh lijiye. Agar wife ne jhoothi complaint likh di hai to aap turant ek anticipatory bail ke liye apply karein taaki arrest ka risk na ho.Aap apne local police station me ya SP office me likhit me complaint de sakte hain ki aapke khilaaf jhoothi FIR hone ka dar hai. Agar wo maintenance ya 498A ka case karti hain to aapke paas jo saboot hain unka istemal court me apna paksh majboot karne ke liye hoga.Aapke kirayedar hone ka fact unke support me directly kaam nahi karega, lekin aap tenancy agreement apne favour me rakh sakte hain. Divorce ya settlement ki baat likhit me aur witnesses ke saamne hi karein. Is stage par ek experienced criminal + matrimonial lawyer ko turant engage karna zaroori hai.
