श्रीमान हमारा पड़ोसी हमें जानबूझकर के गालियां देता है जिसका लिखित शिकायत मैं पुलिस में किया पुलिस ने जानबूझकर कर बीएस की धारा 26 और 35 के तहत विपक्षी के साथ-साथ हमारा का भी नाम डाल दिया जबकि मैंने कोई विवाद नहीं किया मैं चाहता था कि मामले को शांतिपूर्ण तरीके से निस्तारण किया जाए लेकिन पुलिस ने विपक्षी के साथ-साथ मेरा भी चालान बना दिया इस मामले में कानूनी सलाह देने की कृपया करें

यदि आपने कोई विवाद नहीं किया और पुलिस ने गलत रूप से आपका नाम भी सम्मिलित कर लिया है तो आप SP/SSP को लिखित शिकायत देकर निष्पक्ष जाँच की मांग करें। साथ ही मजिस्ट्रेट के समक्ष धारा 156(3) CrPC या 200 CrPC के तहत आवेदन देकर सही कार्यवाही करवा सकते हैं। गलत चालान के विरुद्ध आप न्यायालय में आपत्ति दर्ज करा सकते हैं।

I want to file divorce on the basis of domestic violence and mental harrasment . My husband is mentally unstable . I don't want any alimony . Only want to get rid of him

You can file a divorce petition under Section 13(1)(i-a) of the Hindu Marriage Act on the ground of cruelty due to domestic violence and mental harassment, and also under Section 13(1)(iii) if your husband is mentally unstable. Since you do not wish to claim alimony, the same can be clearly mentioned in the petition. Proper supporting evidence such as medical records, complaints or witness statements will strengthen your case. Aap turant ek experienced criminal lawyer se milkar case ka IPC section detail me samjhe. Agar arrest ka risk hai to anticipatory bail file karein. Saare documents, messages, call records, aur witnesses ka record rakh kar apna defence tayyar karein. Agar case jhootha hai to quashing petition (Sec. 482 CrPC) High Court me file karke relief liya ja sakta hai. Case ki gravity ke hisaab se settlement ya mediation ka bhi option consider karein.

Aapke case me pehle aap apne paas available saare documents, videos, audio recording aur witnesses ka record rakh lijiye. Agar wife ne jhoothi complaint likh di hai to aap turant ek anticipatory bail ke liye apply karein taaki arrest ka risk na ho.Aap apne local police station me ya SP office me likhit me complaint de sakte hain ki aapke khilaaf jhoothi FIR hone ka dar hai. Agar wo maintenance ya 498A ka case karti hain to aapke paas jo saboot hain unka istemal court me apna paksh majboot karne ke liye hoga.Aapke kirayedar hone ka fact unke support me directly kaam nahi karega, lekin aap tenancy agreement apne favour me rakh sakte hain.
