Cheating by your brother in law would tantamount to cruelty against your sister for which she can file a divorce petition as per section 13 of the Hindu Marriage Act, 1955. You have an option to file the domestic violence complaint and maintenance petition aswell.

the evidences that will be required should be of such nature which go on to prove the extra marital affair, like screenshots from his phone, etc. you may also consider hiring a private detective to collect evidence to show extramarital affair of your sister's husband.

alimony may be decided by husband and wife mutually or it may be fixed by the court in cases of disputes. As far as proof of cheating concerned, you can present, call details, messages, watsapp chat or photograph got through detective.
