Exparte Proceeding in 125 case

Family court judge exparte proceesing in lower court. He has asked me to appear on next date and he will recall it. But cant come on next date as i have work committments. I want to know can my lwayer represent me and set aside this proceeding or do i need togoto HC?

if it is ex party order you can move a recall application in the same code and some reasonable ground it will be allowed and expert order shall be cancelled and set aside , you can also move to the High Court against this order and there is your no need of any personal apparent before the unable code

hi friends hope you are doing well. you should go for recall in your case. ask your lawyer to go for recall in the exparte order. exparte order usually recall very early. thanks regards Himanshu Singh Chauhan
