Enquiry about legal ways after decree of divorce
17-Oct-2023 (In Divorce Law)
My husband left me 6 years ago and registered a divorce case on the ground of cruelty. Case was in Delhi high court and i went back to bangalore. because of no family support i was not able to travel. i got only first notice, i didn't get any other notice, not even divorce notice. Recently my friend told me that my husband got divorce on ground of cruelty and 13(1) (ia) and respondent is already exparte. I want to fight against this false allegation. Can i still take some legal action??
Ma'am you need to check the status of the case and proceed accordingly..In the service was deemed to be valid service by the court, you would have been proceeded ex-parte I.e. in your absence. in case the proceedings have been completed and the court has granted a decree in favour of your husband, he would be free to marry again.
You should check the details/status and challange the decree.
I have perused the contents of your query and would advise you to kindly check the status of the ongoing matter wherein you have been proceeded ex parte. Thereafter you may move an application for setting aside an exparte order and fight the case on merits. For further consultancy and legal services you may contact us.
