Elopement for Divorce case filing

19-Dec-2023 (In Divorce Law)
there is a girl, married to a guy from whom she wants to get divorced due to mental abuse and physical exploitation. but that guy is not ready to give hee mutually. her family is also not backing her up due to shame and arrogance of boy. We met few months ago as a friend, and fell in love. We want to get her separated from him and then proceed for legal actions and divorce. So if we decide to elope, then what legal consequences I could face? Also, can he drag my family through any complaint or case? Also what can be done to prevent all this and quash the case easily?

If a lady is already a legal wife of somebody then she cannot marry a second guy till she obtains divorce decree from a court. In your case, you should first ask her to file divorce petition and get it done through a court decree and then proceed.

As per your query he is not ready to give divorce to her. If in this situation you both get marry then he will file criminal complaint against you and her under the provisions of bigamy. You can solomnised marry without inviting your parents to keep them separate from litigation.
