Educated wife filing case to get maintenance what should I do

Hi, after wilful desertion of 18 months in response of my divorce notice my wife filed false dowry case on me and my parents, we got regular bail. She is planning for maintenance just to drag the litigation with my own finance. I have two queries 1) As she intends buy time to litigate matter to harass me and my parents and typical feminist not will to negotiate what cases i can file as counter attack and her and her parents it doesn't matter even if she acquitted but i think this step only destroy her mala fide intension. 2) After EMI and Statutory obligation i am left with only 5K what maximum court grant her maintenance, pls note she is well educated, have learnt many skill and was working in past and working somewhere part time. What can I do?

1. You can file many cases on her as follows a. Defamation b. Contested divorce. c. Adultery d. Criminal conspiracy e. Double marriage and others. But please don't act in turn of revenge. Just be on the right side of truth and everything will work for you. 2. Maintenance can be provided from nil to 2,500 Rupees if you can prove beyond reasonable doubt that you are left with 5,000 Rupees after fulfillment of all obligations.

As per your query

If you can show to the court that you are willing to reside with her, and file a petition for Restitution of Conjugal rights prior to her filing maintenance application in the court. The court would consider two things prior to passing of order on maintenance firstly your willingness to stay with your wife and her resistance secondly, you can show to the the court that she is well educated and can maintain herself.

As per new recent orders of SC with regards to no dragging of relationship for cooling down period for divorce decree whether desertion , metal cruelty to whole family or wrong allegations made by her...everything sounds positive on your side.With regards to maintenance your lawyer can convince the court about her earnings and your other important liabilities to lessen the burden of maintenance
