Physical assault by a spouse constitutes domestic violence and is a punishable offence under the Protection of Women from Domestic Violence Act, 2005, as well as Sections 498A, 323, 506 IPC if cruelty, physical harm, or criminal intimidation is involved. You need not tolerate such conduct merely because of the length of marriage. You may initiate action through the following legal steps: 1️⃣ File a Domestic Violence Petition before the Magistrate seeking protection orders, residence rights, restraining orders, medical expenses, and compensation for mental and physical abuse. 2️⃣ Lodge a police complaint for physical assault and cruelty. The Police are duty-bound to register an FIR under the relevant sections. 3️⃣ If you fear for your safety, apply for an immediate Protection Order to prevent your husband from entering your premises, contacting you, or causing any further harm. 4️⃣ If the situation is irreparable, you may further seek divorce on the ground of cruelty, along with maintenance for yourself and your children under Section 125 Cr.P.C. or the Hindu Marriage Act, as applicable. Your safety is paramount. The law provides strong remedies to protect you and ensure accountability. Do not delay initiating action, as continued abuse strengthens his impunity and weakens your position.
