क्रूरता - पति या पत्नी तलाक का मामला तब दायर कर सकते हैं जब उन्हें किसी प्रकार की मानसिक और शारीरिक चोट पहुंचाई गई हो जिससे जीवन, अंग और स्वास्थ्य को खतरा हो। मानसिक यातना के माध्यम से क्रूरता के अमूर्त कृत्यों का मूल्यांकन किसी एक कृत्य पर नहीं बल्कि घटनाओं की श्रृंखला के आधार पर किया जाता है। कुछ उदाहरण जैसे भोजन से इनकार करना, लगातार दुर्व्यवहार और दहेज प्राप्त करने के लिए दुर्व्यवहार, विकृत यौन कृत्य आदि को क्रूरता के अंतर्गत शामिल किया गया है। परित्याग - यदि पति-पत्नी में से कोई एक स्वेच्छा से अपने साथी को कम से कम दो साल की अवधि के लिए छोड़ देता है, तो परित्यक्त पति-पत्नी परित्याग के आधार पर तलाक का मामला दायर कर सकते हैं।
