Domestic violence and children mantinance

I am government teacher, my husband is RO in sactrate. He is alcoholic. We have two kids, obe is boy(8years), girl(5years). I am facing domestic violence and abusing behavior since last 7-8 years. Husband don't support me echonomicaly since last 1 year I m 46 years old, my husband also 46. His parents took my all jewelry of marriage. Kya muhje dono bachcho ki custudy aur unki education aur future security k liye husband ki salary se money mil sakta hai? Kya shaadi ki jewelery vaps mil sakti h?

Don’t worry …..immediately lodge a police complaint against him or you can file for contested divorce . For maintenance from husband , section 125 application needs to be filed . Custody of the children, you have to file separate application under guardianship and wards act.

Yes, you can get child maintenance (deducted from his salary) and custody easily due to his alcoholism/violence. Your jewelry (Stridhan) is legally yours; you can recover it under the DV Act. As a govt teacher, you have the strength to fight. Consult a lawyer to file a DV case.

Yes under domestic violence act you can claim Shelter, maintenance for child's future , custody of child and the jewellery ofcourse as you asked, you may also get interim relief as and when you approach the court as the courts take need based decisions in such matters.
