Domestic Violence against daughter
14-Jun-2025 (In Divorce Law)
My lone daughter who also does Work from Home was married about 11 months ago in different city.. Her husband and especially her mother-in-law treats her badly and are engaged in all sorts of Domestic Violence like physical abuse. verbal abuse and demanding contribution from the salary I saved my daughter with the help of local police by dialling 112,but my daughter don’t want to give Divorce. At present the daughter is with me. Now what can be done so that the marriage can move on.
Your daughter's safety is the priority. Since she faced physical and verbal abuse, she can file a complaint under the Protection of Women from Domestic Violence Act, 2005 for protection, residence rights, and maintenance. If she is not ready for divorce, judicial separation can be an option, allowing her to live apart legally while preserving the marriage. Counselling or mediation via a Family Court may also help. You may approach the Mahila Thana or Protection Officer in your area. Encourage her to document all instances of abuse and keep records. Legal steps can be taken even without divorce, to ensure her dignity and rights.
according to your query your daughters in laws are harassing her but your daughter do not want to get divorce she want to live with her husband so you have to talk with the family of her husband as well as relative to get rid with that problem if after trying to restore the relations of your daughter but you didn't succeed in that then you have to approach the proper forum to get rid from that thing.
It's unfortunate that your daughter had to face such abuse. Since she is currently not willing to file for divorce, you may consider counselling to help her process her trauma and make informed decisions. Meanwhile, you can file a complaint under the Protection of Women from Domestic Violence Act, 2005, to seek protection, residence rights, and restraining orders against the husband and in-laws. If abuse continues or resurfaces, criminal complaints under IPC Sections 498A and 406 may also be filed. Legal help and emotional support go hand in hand in such cases.
