Divorse Based On 498A And Cruality

My wife deserted me in October 2020 since then no communication .Blocked all modes .In March she filled a FIR 498A and some other sections.It seems 2 weeks ago she unblocked her mobile and started calling once or twice a week when I m ready to file diverse based on 498A annexure and cruality.Wonder suddenly despite filling cases why she giving calls .What was her purpose ? Can i still apply for diverse ?

Yes sir, you can still file for divorce against your wife during the pendency of the cruelty matter. I am not sure why is she calling you despite the petition, but if you want to get separated then file the case.

Divorce can be sought on certain grounds enunciated in section 13 of the Hindu Marriage Act. Wherein desertion is one of the grounds. However desertion should be more than 2 years period. Yes, divorce can be filed and applied on the ground of cruelty. You should seek a detailed consultancy from a lawyer
