Divorce without one person consent under special marriage act 1954

13-Feb-2023 (In Divorce Law)
I married a Hindu girl under special marriage act on 18 of Jan 2022 from Bettiah. Now she is with their parents in siwan Bihar. Due to some issue now she is with their parents and filed a divorce petition under family pressure or willingly not confirmed. Their parents wants to marry her again as per their choice. I don't want to divorce her. Please suggest what to do in such situation as I am not able to contact her any how. Is it possible for her to get divorce without my consent.

If the date of marriage is 18/01/2022 then according to section 14 of HMA the petition will not be successful for long because according to this section date one years must have elapsed since the date of the marriage. But there’s a exception for any kind of exceptional depravity on the part of the respondent. And it not possible for her to get divorce without your consent. For any other legal assistance I am just a call away.

If you are unable to contact your wife then please seek help from the police station immediately or file a complaint under sec 97 crpc. More so for divorce completion of one year is required. Without your consent she can file for divorce but decree can not be granted until you also get an opportunity to contest the same or it’s proven that despite service you deliberately not attending the hearing. For any further legal assistance please feel free to contact Thanks
