Hello !! if both the parties are amicably agree to move forward and do not wish to live together for any reason, then in this scenario mutual consent divorce can be filed in the court and accordingly the court can record the statement and pass order on the respective petition.

If both parties are in agreement, the smoothest and quickest route is mutual consent divorce under Section 13B of the Hindu Marriage Act (or the applicable law depending on your personal law). It generally requires filing a joint petition, recording statements before the court, and observing a minimum cooling-off period of six months (which in some cases can be waived by the court). This process avoids lengthy litigation and ensures a hassle-free separation compared to a contested divorce.

For a smooth and quick divorce, the most hassle-free way is through mutual consent divorce under Section 13B of the Hindu Marriage Act. Both spouses need to agree on separation terms like alimony, child custody and property settlement. Once the joint petition is filed, the court grants divorce in about 6 months (cooling-off period, which in some cases can be waived). If one party is not ready, then contested divorce is the option but it usually takes longer. I can guide you on which route will best suit your situation and assist with drafting, filing and court representation.
