dear client the first thing is that if you want to get divorce from your husband or any party who wants a divorce from each other then they have to wait at least 1 year which means after passing one year you can get divorce each other if mutually you both want to get separate then it take only 6 months otherwise it will take 1-2 years

Hindu Marriage Act, 1955 की Section 14 के अनुसार कोई भी पक्ष शादी के 1 साल पूरे होने से पहले तलाक की याचिका दायर नहीं कर सकता। केवल बहुत विशेष परिस्थितियों (जैसे अत्यधिक कठिनाई या असाधारण पीड़ा – exceptional hardship / exceptional depravity) में कोर्ट अनुमति दे सकता है। पत्नी चाहे तो तलाक़ का इंतज़ार किए बिना भी Maintenance (भरण-पोषण) और Domestic Violence Act या 125 CrPC के अंतर्गत खर्चा/सुरक्षा की कार्यवाही शुरू कर सकती है।

Shaadi ko कम से कम 1 saal pura hona chahiye tabhi petition file ki ja सकती hai. Mutual consent divorce possible hi nahi hoga, phir aapko contested divorce file karna padega Isme aap apne grounds (jaise cruelty, desertion, adultery, mental disorder, impotency, etc.) ke basis par divorce ki petition dal sakte hain. Contested divorce me exact time fixed nahi hota. Court proceedings, evidence, aur appeals ke wajah se 1.5 se 3 saal ya usse zyada lag sakta hai
