Divorce matrimonial issue alimony

31-Jan-2024 (In Divorce Law)
I file divorce case under section 13, Later on wife filed false cases 498a, 323 etc. In divorce case almost 157 day completed but still opposite party not given Written Statement, So I requested court for giving no w.s. order. Also submitted application. But court given next date. So whether I get no W. S. order? What if on next date opposite party given written statement? Can I request court to reject written statement of opposite party because 157 day completed?

before filling the written statement of second party they will give the sufficient ground in before the court why they have not submitted the w/s because it is mandatory to file w/s before 30 days after 30 days you can file the w/s with coundulation application. after 90 days you can file but if you have solid ground

the court has the power to take a decision on whether to accept the return statement and condone the delay if any or to outright reject it. you must insist that the WS not be taken on record as it has been filed after a significant delay. should you have any queries please feel free to contact me

Technically, the maximum period for filing a written statement is 120 days, and no court has the authority to extend this duration. It seems that in your case, the judge may have automatically closed the right of the opposite party to file a written statement. I strongly recommend thoroughly reviewing all your court orders to gain clarity on the proceedings.
