Divorce in case of a out of wedlock child before marriage

We want to separate mutually because of a child out of wedlock from a period before marriage. Is it necessary to stay separately for one year before filing the divorce?

hi the stipulated period of separation is 1 year for mutual consent divorce. however court can waive of 1 year clause if both parties are wanting mutual consent divorce. however there will be 6 month waiting period between first and second hearing

hi it is not compulsory for you to stay separately for one year to get divorce you can file a case in court stating that your husband has cheated you and he has having a valid child before marriage Vidya marriage and you want to get separated from your husband you can file a case against him
