Divorce from a mentally unstable, agressive violent wife,

24-Jun-2026 (In Divorce Law)
Hi I am married from last 5 years through shadi.com during Covid time. My wife had pre-existing mentally unstable condition. Very agressive, abusive . She even abuses her own mother and father . I have proofs which her own mother shared. We have a 4 year old child, and I am worried about him as well. I have tried to get her treated for 1.5 year but she stopped medication. I want to know whether i can get divorce and childs custody. She even violently attacked her own father,so he had to call 112

Based on your query you have solid grounds to approach the Family Court for both a contested divorce and sole custody of your 4 year old child under the Hindu Marriage Act 1955. Your wife’s severe, documented aggression and violent history including the physical assault on her father requiring emergency police intervention (112) constitute strong grounds of Cruelty under Section 13(1)(ia). Furthermore her untreated mental condition and refusal to continue psychiatric medication for the past 1.5 years qualify under Section 13(1)(iii) as a Mental Disorder of such a nature that you cannot reasonably be expected to live with her Regarding your child's custody the court's paramount consideration is the welfare and safety of the minor Her volatile unmedicated state poses a direct threat to a safe upbringing allowing you to heavily contest her fitness as a guardian To establish a airtight case you must secure all medical prescriptions psychiatric records electronic evidence of abuse, and a certified copy or statement regarding the 112 emergency police call. For a detailed strategy and to draft the legal petition you are advised to schedule an immediate legal consultation with Advocate Sudesh Kumar. PG-MBA (London) LLB & LLM

Hello, I understand your situation and the distress it must be causing. Under Section 13(1)(iii) of the Hindu Marriage Act, 1955, unsoundness of mind is a valid ground for divorce if medically proven. 1. Divorce: Your wife's violent behavior, abuse towards parents, and stopping medication can be treated as cruelty. The proofs you have from her mother will be crucial evidence in court. 2. Child Custody: For a 4-year-old child, the court prioritizes the child's welfare. The father's custody claim is strong if the mother's mental condition is proven unstable and harmful to the child. You will need medical documents, proof of violence like the 112 call record, and witness statements. For complete documentation and case strategy, a detailed consultation is required. You may connect with me through LawRato for further proceedings. Regards, Advocate Shamma Perween

Based on the facts stated, the husband may have grounds to seek divorce and also apply for custody of the minor child, but the final decision will depend on evidence and the welfare of the child. Under Section 13 of the Hindu Marriage Act, 1955, persistent abusive, violent, aggressive, and cruel behaviour may constitute “mental cruelty,” which is a recognized ground for divorce. Mere existence of a mental illness is not sufficient; however, if the condition is serious, affects marital life, and results in violent or dangerous conduct, the court may consider it while deciding the divorce petition. In this case, evidence such as medical records, prescriptions showing discontinuation of treatment, messages, audio/video recordings, complaints, statements of her parents, and records of the 112 emergency call regarding the attack on her father may be relevant. Regarding child custody, the paramount consideration under Indian law is the welfare and best interests of the child, not the rights of either parent. If the husband can demonstrate that the child’s physical safety, emotional development, or overall well-being is at risk due to the mother’s conduct, the court may grant custody to him or make suitable guardianship arrangements. The court may also seek medical evaluation of the mother and consider the child’s living environment before passing orders. Therefore, the husband should consult a family law advocate, preserve all documentary and electronic evidence, obtain certified copies of police or emergency records, and initiate appropriate proceedings for divorce, child custody, and interim protection orders, if necessary.
