Divorce Dispute over property. Both party agreed for divorce

31-Oct-2023 (In Divorce Law)
We both want divorce but there is dispute on under construction property. I (boy) paid the complete downpayment of property(10%) directly to builder. I have proofs of bank statement. Property and its respective homeloan is completely on girl name. My name is not there in agreement. Home loan emi has not yet started but will start from jan 2023. She is ready to go for mutual divorce but not ready to give either money or property. I want this property back on my name. Please suggest.

If the behaviour of your wife is intolerable towards you then you can always file complaint against him and his family members. As far as the divorce is concerned it’s better to go for mutual one but if the situation is not favourable then you have to file for the same. For more legal assistance I am just a call away.

Hi. Mutual Divorce is possible only once all decisions with respect to property and other assets are finalised between the parties. it can be included as an agreement as per which the divorce is granted. For further discussion, kindly contact.

You have to contest the matter if she is not agreeing to part with the property. Thats the only way. Court will anyway refer for mediation, if you resolve it there, well n good. Otherwise trial will take place.
