In the eyes of law, a mutual paper divorce / notarized divorce deed done at Lucknow is not a valid divorce. As per Indian law, divorce can only be granted by a competent Family Court through a Decree of Divorce. Regarding Jurisdiction: Yes, as a female you have a special right. Under Section 19(ii)(iiia) of the Hindu Marriage Act, 1955, a wife can file a divorce petition at the place where she is presently residing. Therefore, even if your divorce agreement was executed at Lucknow, you can file a fresh case for Mutual Consent Divorce U/S 13B at the Family Court of your present residence. You will have to file a joint petition with your husband. The earlier paper agreement will be considered as evidence of your mutual consent and will make the process faster (6 months cooling period may be waived by the court). For a valid decree, you must approach the Family Court. A paper divorce will not be considered valid for remarriage or any legal purpose.
