Divorce by Mutual Consent.....................

We got married in Nov 2013. I am a Sikh my husband is a Hindu. We stayed together in Pune until Feb 2015, but had lot of mutual arguments and fights even during that period. After that, he moved to Mumbai for a job. He used to visit Pune on weekends but our fights and arguments did not resolve. Since October 2016, his visits reduced further as we could not stay together and we have not met at all since Feb 2017. We want to file a divorce by mutual consent. Can we file it immediately since we have not been staying together and only been meeting to see if we can resolve things. What will be the total charges including lawyer and court? We do not have any joint account, property or children together. Is there a way to initiate the process online?

Petition can't be filed online. You can file mutual consent divorce petition right away. After filling of petition six months cooling period is there to change your decision. After six months if you both persists with divorce then decree of divorce will be passed. There's no Court fee as such but lawyers fee will differ.

Yes you can file petition for mutual consent Divorce immediately ... No need to have joint Account .. Only once you have to appear before court after that we can appear through Sky pee account by taking permission of Hon'ble Court -- total charges will be around 15,000/ -

If both of you are agreeable divorce by mutual consent can be filed any time. There needs to be a separation period of 1 year. The mutual consent petition has to be drafted with the consent terms. Both of you need to be present in Court once for the filing and thereafter for the decree. There is no way to initiate the process online.

Hello,
There is no online application that can be made for Mutual Divorce. Both of you will have to file Mutual Divorce Petition in Mumbai and after 6 months divorce will be granted. You both can engage one lawyer as there is nothing to divide.

For mutual consent divorce one year separation is mendatory as per the provisions of sec 13 b of the hindu marriage act. So you may file joint petition in March 2018. Or you may file single petition.
