Divorce Advice Yogesh Batra west Delhi.

This is Yogesh Batra. I have been married for past 8.5 years and have two kids. Matrimony was disturbed since day one because of my in-laws continues interference. I have waited for better days but I am loosing myself and don’t want to give a disturbed environment at home where they see their parents fighting every now and then. Kindly advise.

Hi, Regarding your query, you have remedy under the law under the form of Divorce or Judicial Seperation. This can be obtained by three means , either 'Divorce by Mutual Consent'or 'Contested Divorce' or Judicial Seperation. 1) Mutual Consent Divorce:Provided that your spouse is willing, you may enter into an agreement to void the marriage by drawing up the necessary terms of the petition, where aspects like alimony, maintenance, custody of the children etc., are already discussed and put down on paper. This effectively saves you the trouble of an extended litigation . 2) On the other hand, you can bring a divorce petition before Court wherein you claim divorce on grounds of cruelty. Any form of physical/mental torture which makes the marriage unlivable are grounds for seeking divorce. 3) If you are both not yet ready to Divorce, you may seek Judicial Separation from one another. Judicial Separation provides the spouses a period of introspection for a period of one year in which they may live separately from one another. The marriage will still continue to exist, however after a period of one year, if the spouses do not wish to live with one another, they are entitled to seek divorce on such grounds.
