Divorce a drinking husband and girl child custody

My husband is drinking often even after lot of fights. now we have a girl baby of 5months want to file a divorce and marriage was happened last year. Will i can able to file a divorce oneside and get a child custody?please help

Yes, you can file for divorce by filing a petition for dissolution of marriage before the court if you have decided to do so. One year must have been completed from the date of marriage. Your husband will contest the case and it will be decided on facts and evidence from both sides.

100%. The custody of children, especially young female children will 99.9 % be given to the mother. Yes you can file divorce, without your husband's co-operation. It's called contested divorce. If you are a Hindu, and if you have got married under Hindu rituals, then 13(1) a of the Hindu marriage act is the provision of law for filing divorce Under cruelty grounds.
