Q: it is right time to take over the property procession

Hi Team,My name is kamala, I have my own property with all the documents under my name. My relatives trespassed and illegally disposed from my property and put additional lock on the main door to prevent entry to the property. and filed a perjury case in civil court and prayed for permanent injunction against me and they enjoyed the procession on the property. case dismissed and court states, that i have the procession. Q- Kindly confirm whether i can take the procession now.

Make your heart strong to read this reply. See in India property laws are a joke. Trespassers and criminals can enjoy rights over a property illegally. If it's a western country, if you call the police, the police will evict them. But here once a person occupies a property the police won't/ cannot interfere, you only need to file ejection suit which will indeed take few years. Pathetic state of affairs. But you can seek damages. But if your state has a land grabbing cell, then a criminal complaint can be attempted. And police do nothing without bribe. If you hire a proper lawyer, and if he/she is genuine to fight your case, you may get your property back in few years.



Q: I'm facing matrimonial cases in thanjavur courts

Which high court is applicable for thanjavur jurisdiction, Madras high court or Madurai high court for appeal purposes??

Q: Divorce case filed against my husband , due to criminal cases

I have already filed my Divorce case in family court, Its been 2yrs now ,still not even a 1% improvement.I dont know what else to do this part now they were saying again we need to wait 2more months due to summer vacation .Recently ,they have filed interim pettion also.The problem between us , he was lied that he completed B.E and have job in tech companies, he didnt compelet 12th also ,I found this after my marriage. And also, he was involved 2major case that is also he didnt tell bfr marriage

Unfortunately Indian legal system moves at a snail phase (tortoise speed). If you want to know whether your lawyer is doing the right thing, you can consult other lawyers and get legal opinion (like receiving a second opinion from another doctor).



Q: My wife is not showing the child for 2 years

My wife is not showing the child for 2 years and she simply left to USA after filing divorce in Chennai, I applied for visitation right petitions, but she went ahead and file a DV case with false allegations in US court. Now my visitation right case is prolonged for years and opposite lawyer keeps referring the false DV case. I am really suffering and I am feeling that my son would have already forgot my face and boding in the last 2 years. Is there any solution?

You must fight your case in U.S. Apply for VISA stating this as a genuine reason. That would be advisable considering the facts of your case. Indian court's order is not binding in U.S. People will suffer their Karma. Just keep moving. You must have not let her elope with the kid. You must have filed an interm application seeking cout's intervention to stop her from taking the child to U.S.

We are respondent in the case. The case was dismissed in magistrate court. Petitioner has filled appeal in sessions judge. We had recieved notice and we had attended the court and we had filled objections. The next stage is arguments . So can you please explain what will be the process after this.

Judgement. Appeal will only have 3 to 4 hearings maximum. Main delay will be for the case records to reach from lower court to the Session's court. Once that happens, both sides will be heard on the same day or written arguments will also be submitted. Then orders.
