You can opt for mutual consent divorce to get rid of the same and help you get an early disposal. Contesting a divorce petition will take its own sweet course of time. Feel free to contact me for seeking any legal advice as regards the same.

It can be frustrating when you have a spouse who is not cooperating to end the matter in peace. In this situation firstly you will need to ensure that summons has been served to the husband correctly, if he is deliberately avoiding the summons then you will need to apply for substituted service of the documents and then prove court that the husband is avoiding service, if you are able to satisfy the court that service is completed then you may apply for ex-parte order meaning matter be dealt without your husband. unfortunately such procedures can take lot if time, its best that you some how engage in discussions with him and convince him to agree on the divorce which would make the process a lot quicker.

Well, in order to seek Divorce, you need to file a Unilateral Divorce Petition, if he comes either on his own or via his Advocate, that is, good. If he does not come, nor send his lawyer to represent him, then, you can seek an Ex Partee Divorce.

Well, your Advocate can file an Application for seeking Ex Partee Order, if neither she nor her Advocate is continuously appearing before the Honourable Court. This Application can be filed if the other side is continuosly remaining absent with their Advocate for more than 3 Hearings.
