LEGAL ADVICE Your case clearly discloses cruelty (emotional abuse) and adultery, which are valid grounds for divorce under law. You are well within your rights to initiate legal proceedings. 1. First Step – Legal Notice: You may issue a formal legal notice stating your intention to seek divorce, placing on record his conduct and calling upon him to respond/settle. This often creates pressure and may open scope for mutual settlement. 2. Choice of Proceedings: If he cooperates → proceed with Mutual Consent Divorce (faster and less adversarial). If he does not respond → file Contested Divorce on grounds of cruelty and adultery. 3. Child Custody: Custody of a 3-year-old child is ordinarily granted to the mother, considering welfare of the child. His visitation rights can be regulated by the Court. 4. Alimony: Even if you presently do not seek alimony, your legal right remains intact and can be exercised at any stage. Do not waive it without proper consideration. 5. Protection: If there is continued harassment, you may also invoke remedies under the Domestic Violence Act for protection and residence orders. ⚖️ Conclusion: Issue a strong legal notice immediately and be prepared to proceed legally. Your case is legally sustainable and well-supported. Proceed decisively—delay only weakens your position.
