Details required for Mutual Divorce in marriage

What is the procedure for Divorce and how log would it take and charges? I am working, will i get allimony? My husband income is quite high from me however currently he is under resignation with no job surity , will i still eligible for allimony if he will declare himself poor or something like that

if it is mutual, you need to show 1 year of separation and thereafter filing as per statute final hearing is after six months in contested, it cannot be assured how much time will it take, yes, even if your husband is not working and there is a specific judgement where he has to declare everything as well ascourt may ask him to work on daily wages to repay you off. details are required for proper guidance further

the procedure of divorce is dependent on the mode of divorce which means if it's a contested or mutual divorce. in case of mutual divorce the time required is 18-24 months on an average. in case of contested divorce it takes longer depending on how the opposite party behaves. if your husband used to earn more than you then you would be eligible to alimony provided he still earns more than you. in case your husband has lost his job and you are earning good amount of money your husband might claim alimony from you.

If both husband and wife agreed for divorce then file a joint petition for divorce by mutual consent . And minimum one year separation is required for filing mutual consent divorce petition. In mutual consent divorce two important things are child custody and alimony matter , every thing is fixed by both parties free consent. Mutual consent divorce takes 6 months time. And cooling period for mutual consent divorce is 6 months. For mutual consent divorce both the parties required to wait one year from the date of marriage. But without detail discussion proper consult is not possible.
