The ultimate deciding factor with regard to child custody is welfare of the child. Now that the child is in the US the father will have to visit the child in the US only if at he is granted with visitation rights. The child cannot be forced to be brought to India. NCPCR is not the forum. The aggrieved party has to approach the court for visitation.

when there is a dispute between D husband and wife regarding the custody of the child are for the vegetation rides of the child in case of the separated parents the only remedy is to approach the family court under the relevant act to get the child custody or for the visiting rights. and the court will consider the grievance between the both the parties and pass appropriate orders

Hi, there is no such act called Bigamy Act. But bigamy is an offence and also a ground for divorce. Moreover law do not recognize the second marriage while the first one is subsisting. please contact a good advocate near you to regain custody of the child. Good luck
