Defence Strike Application Not Granted - Advocate flavouring Accused

We had hired a lawyer who initially worked well for first 5-6 months but in Feb 2024 he shaked his hand with other party's lawyer and agreed to settlement to pay 14 lacs. Accused stopped responding to the settlement agreement, no motion files and signed, later cancelled the agreement. Our lawyer has not been taking any action , no court order has been followed by accused till now. Interim maintenance arrears pending of around 2.5 lacs, executions pending, not arrested.

If there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

Would advise you to seek a detailed legal Consultation from some other lawyer having expertise in matrimonial laws. Do brief him and get the case documents legally perused to enable him to tender an appropriate opinion. Need to go through the court orders aswell

If the husband avoids paying maintenance, he will be arrested, the court considers the wife's conditions, if she can manage her expenses, the court will be lenient towards the husband, otherwise take strict action against him.

you have to file execution for pending amount and if you have withdrawn any case , you can reopen the case , dont agree with the agreement , and go for fresh agreement . once you will take action , he will be compelled to pay and other proceedings as well be effective.
