Defamation on wife for posting in social media

Hello, my NRI wife left me in Oct 2018 when I decided to comeback from abroad. I appealed for RCR. She is not interested to comeback. In social media she is saying im ex husband in a audio interview and saying I am going through divorce , #nobodieswife in different posts even though we have not applied for divorce. Can I file a defamation on this. Will it be worth for criminal defamation? Can this be cruelty and can I apply for divorce based on desertion and mental cruelty.

Get withdraw your RCR case immediately and send a legal notice to her calling upon her to explain why criminal defamation case should not be filed against her. You can file such case under Section 499 and 500 of IPC since she is making false allegations and thus your reputation has come down. You may also file civil defamation case claiming huge amount.

the action by your wife will not give rise to a cause of action for you to file a criminal defamation if that's what you mean ,but you can make use of this as a ground for divorce, in addition to desertion by her.
