Daughter in-law rights to stay

Dear Sir/ Madam I got an arrange marriage done in Jan went to inlaws house for 1week only then went to Australia with my husband on 30th march he sent bk to India with fake medical reports that Im diagnosis with cancer overall it was a 3month we stayed together later in Nov my husband has sent me a divorce notice after which me my family tried approaching to get the reason noone is responded infact lot of allegations wer put on me then later I hv filed FIR Dv case maintenance case but he is not even appring in court only his lawer takes dates & go of its 2 years now I'm only suffering
1.Now my brother wife is not ready to keep me in my parents house can I go to my mother-in-law and stay
2.al thou I hv not got any court order to go there as all my cases are goin on my lawer says it's not rgt to go without any shelter order from court.
3.if I go will my case bcom weak & I might face problems or it wil b stronger and help me in getting som response from husband or in-laws

Dear Madam,
Till legal divorce is granted you will be considered as legal wife as such you can immediately go to your husband's house and get protection order by filing Domestic violence case and thus continue to stay in your husbands house. The Supreme Court says it is the right of wife to stay in Matrimonial house even though she filed several cases against her husband.

your lawyer is right in saying that you you cannot just go and stay in your husband's parents house without an order from the Court. And the court cannot and will not make such an order against the will of your husband's parents unless that house is your husbands ancestral property or in anyway he is also having an existing right in the said house.
