Custody to mother incase she is involved in online chats

Hi, we are having troubled marriage since a while and recently my husband has seen some obscene chats between me and another person. I am a mother of 7 years old so and I look after his education and necessities both financially and as a whole. He is threatening me of taking away my son. We are planning for mutual divorce but he said he will not let my son stay with me nor the flat which is in both me and my husband'. Please advise if this is possible that I lose my son's custody.

Well being the biological father of the child, your husband can take full/ partial custody of the child and for that he has to approach a Judge under The Guardians and Wards Act. It is a possibility that you might lose the custody of the child but that is totally dependent upon the Judge ,but one thing is for sure that this will be a long legal battle.

dear client as per your query since you both are planning for mutual divorce so you can file for it in court also you can file for custody of your child to get his custody as you are taking care of your child financially and morally..
