Cross examination of wife in 125 crpc

18-Mar-2024 (In Divorce Law)
For the problems between couple generally there are no eyewitness as people only get to see the impact. How can i give evidence for the claims i make about her? You can never be prepared to record things for future reference unless someone provokes in a planned way. How should i take it? Also regarding question my lawyer says since it is just 125 crpc we should stick to few select questions only whereas i think the entire thing should be placed before the judge. Please advise.

Dear Sir, Please be informed that 125 proceedings are summary proceedings and cross examination may curtailed if the judge is very particular and knowledgeable. He may say that it is mere rest of time to ask the questions which are not related to the issues involved in the case. Further, in most of the family cases husband and wife will be examined and there will be no necessity of examination of other witnesses.

your advocate is right in his advice that in a 125 CrPC matter you need not go all out to prove the points and heach and every matter which you think relavent to the case Vishal can be reserved. for a future maintenance case.
