Court jurisdiction in divorce case.

21-Jul-2024 (In Divorce Law)

Both the girl and boy are working at Mumbai since last 10 years and both are having Adhaar card with Mumbai address but girl has filed multiple cases against boy and his family at her parental place to harass them. Can we ask for shifting of atleast criminal cases to Mumbai. Kindly advise.

you can apply for transfer of cases to the Supreme Court if states are different and can apply to the High Court if both places are in one state. Where is she working now? Usually convenience of female is seen to be upheld in such cases. if you want to transfer case you will have to show her current residence and job at Mumbai.

If you want to get the Criminal Cases transferred from once city of Maharahtra to Mumbai, then, you have to approach Hon'bld Bombay High Court. If you want to transfer the case from one State of India to another State of India, then, you have to file Transfer Petition in Supreme Court of India.
