Counter claim dismissed & exe party without cost.
29-Aug-2023 (In Divorce Law)
I found the following lines in a matrimonial suit :
During the pendency of hearing of suit, no step was taken by the petitioner husband. So the suit filed by him was to be dismissed. But as the respondent wife has filed a counterclaim for a decree of divorce it was fixed for ex Parte hearing of counterclaim.
The final decree of a matrimonial suit states , " Hence it is ordered, Counter claim dismissed & exe party without cost. Decree sealed & signed on this date. "
I want to know : Does it mean divorce granted?
Please help, I am in trouble.
No. it means the prayer for a decree of divorce has been refused by the Ld. Court. Your marriage is still subsisting. You have to file appropriate appeal against the order to get the Order & Judgement set aside for a decree of Divorce.
it means counter claim , the claim by you is dismissed and ex parte decree passed you can very well go for review of the order before going for high court any lawyer will force you to go to high during this time you need to think technically
I Need copy of whole judgement in order to advice you regarding this matter. just small portion of the judgement is not good enough please book an appointment and send me copy of whole judgement so that I can advise you further
