Dear queriest,, as per your query you have mentioned about the case filed before the honorable court under the grounds of cruelty and later you withdrawn the same and now you want to go for mutual divorce, yes you can do the same by filing under section 13B of the Hindu Marriage Act if you are Hindu and it almost take 6 months and the same period can be waived if the Honourable Court thinks fit for the same.
As per your query,
Earlier you had filed a divorce petition on the ground of cruelty and you have withdrawn the same. You could have converted the same into mutual consent petition by amending your petition into mutual consent under section 13B of Hindu Marriage Act. In this case six months waiting period would be automatically waived off.
If you have filed a fresh petition for Mutual consent divorce, you need to convince the court for waiving the six months period.
Documents required are Photographs of marriage, Invitation Card, Photo Identity of both the parties.
Regards.
