Conditions to apply for Annulment of marriage

22-Sep-2023 (In Divorce Law)
Within 2 days of my marriage (hindu) my wife cleared her intentions to leave me. she saw white patches on my granny's face in photo kept in marriage ceremony and a patch on my mom's body. She started feeling cheated. She performed Medical test on my mom, result said its temporary and not a genetical issue. Then her parents insisted her not to break marriage. But she was reluctant to listen anybody. On persuasion by her family she agreed to come for honeymoon but there also she only enjoyed foreplay. Upon arrival she came home to explain me the reason of breakup accompanied by 12 uninvited guests. She spoke up all the things we discussed and did in the honeymoon hotels which are considered too private to talk in public. Now proceeding for separation. I met her and her lawyer recently. They r insisting me to take charges of impotence on my head to solve out the matter quickly. I'm finding it offensive. Need advise for divorce or decree of nullity? on which ground?

Sir,
Divorce cannot be filed within one year of marriage and if its not even one year since your marriage that could be one the reason they are insisting on nullity. Again nullity cannot be filed by consent so still she will have to file it one sided and she will have to prove to the Court her claim. You can contest it in Court.

As per your query

If you both have decided to get separated from each other you can very well stay separatley an file a Petition for Mutual consent and obtain divorce jointly. No need to take the gound of impotence as the same my harm in future if you again decide to get married to any other lady.

Hello
As mentioned by the entire case it seems that your wife is very much keen in divorcing you. Impotency is one of the ground for annulment and the problem should be even on the day of filling the petition and it should be supported with proper evidence.
