Clarity required for filing a domestic violence case

Please help with answers to my queries 1. I was a resident of Delhi till 2010, and was married in Delhi in December 2010, after which i moved to Ghaziabad. Please confirm if a domestic violence case can be filed in Delhi on the basis of my marriage in Delhi? 2. I do not want to file a divorce case, but i want the custody of my children and stay separate because of the mental abuse in the house. My question is, will my kids be allowed to stay with me till there is a decision to the case?

rAs you wanted to know in your problem that you were married in Delhi in 2010 and after marriage you shifted to GhaziabadYou also have a son whose custody you want for yourself and you also want to file a domestic violence case against your in-laws and your question is whether I should file the domestic violence case from Ghaziabad or Delhi. It is not necessary that you have to go back to Delhi for the caseYou can file a case of domestic violence against your husband from the place where you are currently residing. This is not illegal. There is a legal provision in this that now you are living separately from your husband, then you can file a case of domestic violence against your husband from there. Can also file a lawsuit

Your matter is pertaining to Divorce or domestic violation according to your statement. You want to your child custody with divorce. yes you are eligible from that only minor child. Some more options are available for women. you can call me when need help.
