Clarification regarding alimony to be claimed by husband

I hv 2 children aged 1.5 yrs & 6 yrs in 8 yrs of marriage. I m.a freelancer writer earning 20000 monthly, depending on work flow. Husband is army officer earning a lakh or more on monthly basis. I want to understand the alimony money I should claim as he wants mutual divorce. Both Hindu.

Alimony means Stridhan. You should make yourself clear. Whether you are looking for a one time settlement amount or you want to get monthly maintenance from your husband. Provision of maintenance has been provided to wife and children both under the Hindu Marriage Act and Criminal Procedure code. So first of all you have to be clear that you want to get alimony or maintenance.

You can claim alimony as per the capacity of you husband but you know no body ready to pay the amount so you need to pressurised him by way of filling of case like D.A. Act as well as maintenance and dowry .

Alimony mostly depends on all the incomes and properties of the husband and also on the earning capacity nd capabilities of wife and who is going to take care of childrens ie who is going to expend on their education and other stuffs mostly in a mutual divorce both the parents expend nd tk care of their children and it will be decided mutually between both the parents. So it depends on both sides how they distribute their expenses mutually.

You can claim alimony money on the basis of your children. You have two kids so you have to maintain them both as they education , study material , cloathing , medical care , etc and day to day needs . You now calculate on this basis and for mutual divorce he will accept the demand . And many things will be more easily explain by your lawyer when you meet .

Definitely you should claim for alimony for the maintenance of your child with future aspects like education, marriage, medical, maintenance etc and also for yourself.....
And mutual is the best divorce here.....
